Terms & Conditions

1. GENERAL PROVISIONS

These Terms and Conditions govern the use of the website and the provision of boat rental services.

By using the website and completing a reservation, the user confirms that they have read, understood, and accepted these Terms.

2. RESERVATIONS AND CONCLUSION OF CONTRACT

Reservations may be made via the online booking system or directly.

The contract shall be deemed concluded at the moment of:

  • confirmation of the reservation and/or

  • payment of the deposit

The confirmation shall be sent via email.

The user is responsible for the accuracy of all submitted information.
The provider shall not be liable for any errors made by the user.

 

3. PRICES AND PAYMENT

All prices are expressed in EUR.

Payment methods:

  • online payment

  • cash

Deposit: EUR 100 (non-refundable)

The provider does not process or store card details.

4. REFUND POLICY

4.1 Deposit

The deposit in the amount of EUR 100 is non-refundable in all cases, including but not limited to:

  • cancellation by the user

  • failure to appear (no-show)

  • changes to the booking date

  • late arrival of the user

 

4.2 Remaining Balance

No refund of the remaining balance shall be granted once the rental has commenced.

 

4.3 Adverse Weather Conditions

In the event of adverse weather conditions or for safety reasons, the provider may:

  • reschedule the booking; or

  • offer an alternative date

Refunds are not mandatory unless otherwise decided by the provider.

 

4.4 Cancellation by the Provider

If the provider is unable to deliver the service (e.g., due to malfunction, safety concerns, etc.), the provider may:

  • offer an alternative date; or

  • issue a refund of the amount paid

 

4.5 Termination of Rental

No refund shall be granted if the rental is terminated due to:

  • violation of rules

  • unsafe or dangerous behaviour

  • consumption of alcohol or drugs

 

4.6 Banking Disputes

Any attempt to obtain a refund through a bank or financial institution shall not affect the validity of these Terms.

The user acknowledges that payment has been made in accordance with these Terms.

5. ONLINE SYSTEM

The provider shall not be liable for:

  • technical errors

  • system unavailability

  • duplicate bookings

 

6. TYPES OF RENTAL

6.1 Bareboat Rental

The user must possess a valid license and assumes full responsibility.

 

6.2 Rental with Skipper

The skipper shall make all decisions concerning safety.

 

7. AGE REQUIREMENT

The user must be at least 18 years of age at the time of entering into the rental agreement.

In the case of bareboat rental, the user must also comply with all legal requirements for operating a vessel in accordance with the applicable laws of the Republic of Croatia.

The provider reserves the right to request a valid identification document for the purpose of verifying the user’s identity and age.

In the event that false or inaccurate information is provided, the provider reserves the right to refuse or terminate the service without any refund.

 

8. LIABILITY FOR PERSONAL BELONGINGS

The provider shall not be held liable for any loss, theft, or damage to personal belongings of the user or third parties during the rental period, regardless of the cause.

The user is responsible for safeguarding their personal belongings and is advised not to leave valuables unattended on the vessel.

All personal belongings are brought and used at the user’s own risk.

9. VESSEL HANDOVER (CHECK-IN / CHECK-OUT)

The handover of the vessel shall take place at a pre-agreed location and time.

At check-in, the user is required to inspect the vessel and its equipment and immediately report any defects or damage.

The vessel shall be deemed accepted in proper and satisfactory condition if no objections are raised prior to the commencement of the rental.

At check-out, the user is required to return the vessel:

  • at the agreed time

  • at the agreed location

  • in the same condition in which it was received, allowing for normal wear and tear

In the event of late return, the provider reserves the right to charge additional fees.

Any damage or malfunction occurring during the rental must be reported immediately or at the latest upon return.

 

10. PENALTIES AND VIOLATIONS

The user shall bear full responsibility for all fines, violations, and additional costs incurred during the rental period.

This includes, but is not limited to:

  • maritime and traffic violations

  • fines imposed by competent authorities

  • port and mooring fees

  • intervention or rescue costs

If such costs are issued after the rental period, the user agrees to settle them in full upon first request.

The provider reserves the right to recover such costs from the deposit or by other available means.

11. SECURITY DEPOSIT

The user is required to pay a security deposit prior to the commencement of the rental as collateral for any potential damages, costs, or liabilities.

Deposit amount:

  • EUR 400 for bareboat rental

  • not required for rental with skipper

The deposit serves as security for:

  • damage to the vessel or equipment

  • late return of the vessel

  • insufficient fuel

  • fines and violations

  • other costs caused by the user

The deposit shall be refunded after the rental provided that:

  • no damage has occurred; and

  • no additional costs or liabilities exist

In the event of damage or incurred costs, the provider reserves the right to retain part or all of the deposit proportionally.

If the damage exceeds the deposit amount, the user shall be liable to pay the difference upon request.

 

12. SAFETY AND CONDUCT

The following are strictly prohibited:

  • alcohol consumption while operating the vessel

  • use of drugs

  • dangerous or reckless behaviour

13. ROUTE AND SCHEDULE

The route and schedule may be modified for safety reasons.

 

14. DELAY

Delays do not entitle the user to an extension of the rental period.

 

15. USER LIABILITY

The user assumes full responsibility for all matters arising during a bareboat rental.

 

16. PROVIDER LIABILITY

The provider’s liability shall be limited to the maximum extent permitted by law.

 

17. FUEL

Fuel costs shall be borne by the user.

 

18. DAMAGES

Any damages shall be charged additionally.

 

19. MAXIMUM NUMBER OF PERSONS

Exceeding the permitted number of persons shall result in termination of the rental without refund.

 

20. RECORDING AND MARKETING

Photos and videos may be used for promotional and marketing purposes.

 

21. FORCE MAJEURE

The provider shall not be liable for failure to perform obligations due to unforeseen circumstances beyond its control.

 

22. DATA PROTECTION

In accordance with the Privacy Policy.

 

23. GOVERNING LAW

These Terms shall be governed by the laws of the Republic of Croatia.

 

24. AMENDMENTS

These Terms may be amended at any time.
